Scope of application.
The General Terms and Conditions (hereinafter GTC The following terms and conditions apply to all legal transactions concluded with Arthur Rüegg Fahrzeug-Zubehör AG.

Arthur Rüegg Fahrzeug-Zubehör AG reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order is authoritative, which cannot be changed unilaterally for this order.

Conclusion of contract.

Our products and prices are deemed to be an offer. However, this offer is always subject to the condition that the contract cannot be delivered. The purchase contract for products from Arthur Rüegg Fahrzeug Zubehör AG is concluded as soon as the customer places an order in the Internet store. www.rueggag.ch, (hereinafter Store referred to below) places its order by telephone or e-mail (hereinafter referred to as “Purchase contract”).

The arrival of an Internet order is indicated to the customer by means of an automatically generated order confirmation from Arthur Rüegg Fahrzeug-Zubehör AG to the e-mail address provided by the customer. Receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the customer that the order placed has been received by the store and that the purchase contract with Arthur Rüegg Fahrzeug-Zubehör AG has therefore been concluded subject to the possibility of delivery.

B2C customers can store in the store as a guest or as a registered customer via a user account. For a B2B customer account, it is necessary to apply for such a user account. This can be done via the onlineNew customer application can be requested.

The customer undertakes to provide all information necessary for opening the user account truthfully and completely. The customer bears full responsibility for his user account, in particular for the protection of his user name and password. He undertakes to treat this data confidentially and not to make it accessible to unauthorized third parties. All orders placed via the online account are assigned to the customer as the account holder and are binding. Damage caused by misuse of the user account or by incorrect manipulation shall be attributed to the customer.

Arthur Rüegg Fahrzeug-Zubehör AG is not liable for the misuse of access data by third parties. The customer is obliged to report any misuse of his user account to the provider immediately.

Arthur Rüegg Fahrzeug-Zubehör AG treats all access data as strictly confidential.

There is no entitlement to admission to a user account. The Provider is entitled to refuse to admit a customer without giving reasons or to immediately revoke an admission once granted at any time without prior notice and without giving reasons.

Reasons for such a measure may include in particular: incorrect or untrue information provided during registration, misuse of the information provided, jeopardizing the functionality of the online store, failure to meet payment deadlines, insolvency or bankruptcy of the customer.

The customer may at any time request in writing the deletion of his user account and the cancellation of his registration, provided that this does not impair the processing of ongoing contractual relationships.

Arthur Rüegg Fahrzeug-Zubehör AG undertakes to delete all user data and all other personal data of the customer as soon as they are no longer required for the execution of the contract and there is no longer any legal obligation to retain them.

Product range and scope of delivery.

All items in our range are delivered from our Swiss logistics center.

Deliveries are only made to addresses in Switzerland or the Principality of Liechtenstein. We are not liable for delays in delivery caused by manufacturers or other third parties.

Technical data.

We are not the manufacturer of the items offered. All technical information and data are based on the information provided by the manufacturers concerned and are not a guarantee by Arthur Rüegg Fahrzeug-Zubehör AG for specific properties. We cannot accept any liability for any errors in information or transmission. This applies in particular to any resulting consequential damage and costs.

Conditions.

For business transactions between Arthur Rüegg Fahrzeug-Zubehör AG and the customer, these GTC apply exclusively. Deviating, individually agreed provisions between the two parties take precedence over our GTC.

Prices.

Our prices are stated in CHF excluding or including VAT. The gross prices (RRP) are recommended retail prices and are not binding for retailers. Pricing for invoicing is based on the terms and conditions valid on the day of dispatch or collection. Our prices are kept as stable as possible. Nevertheless, we reserve the right to change prices at any time. Our advisory team will be happy to provide you with information on current prices, special prices for larger quantities or special offers. The current prices are always listed in our store.

Payment.

Customers can use the payment options offered in the store under payment methods. In the case of payment by credit card or other instant payment methods, the amount is debited when the order is placed. Our invoices are payable net. From the 2nd reminder stage, we charge CHF 20 per reminder for damages caused by default (OR Art. 106). Furthermore, 5% interest on arrears is due from the due date of the invoice. Payments must be made in CHF.

Retention of title.

Until full payment of the invoice amount, including any reminder fees and interest on arrears, Arthur Rüegg Fahrzeug-Zubehör AG retains title to all items. This can be registered at any time at the relevant location.

Complaints.

Complaints must be made in writing within 5 working days of receipt of the goods. If these are accepted, the customer is entitled to have the defects remedied or, if this is not possible, to have replacement goods delivered in perfect condition.

Guarantee.

We guarantee the flawless quality of our items and provide a 24-month warranty from the date of delivery. The invoice serves as proof of purchase. Warranty claims must be processed through our shop without exception. Our warranty only covers the replacement value of the goods, not any additional costs. We accept no liability for consequential damages. The warranty does not cover damage resulting from modifications or repairs carried out by the customer, or damage resulting from wear and tear, force majeure or failure to observe the operating instructions.

Returns.

The customer has the right to return the delivered goods within a period of 10 working days. The right of return begins upon receipt of the goods by the customer. The returned items must be undamaged, in mint condition and in perfect original packaging. Returns must be processed using our returns application without exception. The return shipment is at the expense and risk of the customer. If the above conditions are not met, the right of return expires and we will charge a processing fee of CHF 30. Items that were specially procured at the customer's request are excluded from the right of return.

Note on data communication.

Given the current state of technology, it is not possible to guarantee that data transmitted via the Internet will always be error-free and available at all times. Arthur Rüegg Fahrzeug-Zubehör AG therefore accepts no liability for the constant and uninterrupted availability of its online trading system or for technical or electronic errors in connection with the web shops or other electronic communication. This applies in particular to delayed processing or acceptance of orders, insofar as these errors are not the responsibility of Arthur Rüegg Fahrzeug-Zubehör AG.

Data protection.

When collecting, processing, and using personal or company-related data, we comply with the provisions of Swiss data protection legislation.

All content on our shop is protected by copyright. Downloading and printing individual pages or parts thereof is permitted, provided that neither copyright notices nor other legally protected designations are removed. All property rights remain with Arthur Rüegg Fahrzeug-Zubehör AG in all cases. The complete or partial reproduction, electronic or conventional transmission, modification, linking, or use of this website for public or commercial purposes is prohibited without our prior written consent. Further property rights of third parties remain reserved.

Place of jurisdiction.

Our business activities are based exclusively on Swiss law. The place of performance and jurisdiction is Zurich.
