Terms and Conditions (AGB).<\/p>\n<\/div><\/div>\n\n\n\n

1. Scope of application<\/strong><\/h5>\n\n\n\n

The General Terms and Conditions (hereinafter GTC <\/strong>shall apply to all legal transactions conducted via the Internet ordering platform www.rueggag.ch (hereinafter referred to as R\u00fcegg-Webshop<\/strong> called), by telephone or e-mail with Arthur R\u00fcegg Fahrzeug-Zubeh\u00f6r AG (hereinafter referred to as R\u00fcegg AG<\/strong> called) can be concluded. Deviating and other conditions require a special written agreement and take precedence over these GTC.
R\u00fcegg AG reserves the right to amend these GTC at any time. The version of these GTC applicable at the time of the order shall apply, which cannot be changed unilaterally for this order.
The products offered by R\u00fcegg AG are aimed exclusively at customers whose place of residence or registered office is in Switzerland or Liechtenstein. Deliveries are made exclusively to addresses in Switzerland or Liechtenstein.

2. Information<\/strong><\/h5>\n\n\n\n
2.1 Product and price<\/strong><\/h5>\n\n\n\n

Images of products in advertising, brochures, the R\u00fcegg webshop etc. are for illustrative purposes only and are non-binding.
All prices published in the R\u00fcegg webshop are stated in CHF including or excluding VAT. The published gross prices (RRP) are recommended retail prices and are not binding for retailers. R\u00fcegg AG reserves the right to change the prices of the products offered at any time. The price in the R\u00fcegg webshop at the time of the order is decisive for the conclusion of the purchase contract. Pricing for backorder deliveries is based on the terms and conditions valid on the day of dispatch or collection.<\/p>\n\n\n\n

2.2 Availability and delivery time<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG attaches great importance to providing up-to-date and accurate information on availability and delivery times in the R\u00fcegg webshop. However, delivery delays may occur, particularly due to production or delivery bottlenecks. All information on availability and delivery times is therefore without guarantee and may change at any time.

3. Conclusion of contract<\/strong><\/h5>\n\n\n\n

The products and prices in the R\u00fcegg webshop are deemed to be an offer. However, this offer is always subject to the condition that the contract cannot be delivered.
The purchase contract for R\u00fcegg AG products is concluded with R\u00fcegg AG as soon as the customer places their order in the R\u00fcegg webshop, by telephone or e-mail (hereinafter referred to as the purchase contract).
The arrival of a R\u00fcegg webshop order is indicated to the customer by means of an automatically generated order confirmation sent by R\u00fcegg AG to the e-mail address provided by the customer. Receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the customer that the order placed has been received by the R\u00fcegg webshop and that the purchase contract with R\u00fcegg AG has therefore been concluded subject to the possibility of delivery.

4. Delivery date<\/strong><\/h5>\n\n\n\n

A provisional delivery date is communicated to the customer with the order confirmation or the customer is contacted and an individual delivery date is agreed.
If R\u00fcegg AG is in default of delivery, the customer has the right to withdraw from the contract from the 10th working day after the originally announced delivery date (except in the case of special orders). In this case, R\u00fcegg AG shall reimburse the customer for any amounts already paid in advance. There are no further claims against R\u00fcegg AG.

5. Delivery<\/strong><\/h5>\n\n\n\n

All R\u00fcegg AG products are delivered from the R\u00fcegg logistics center in Switzerland.
All delivery and collection options are available to customers and are displayed in the R\u00fcegg webshop during the ordering process.
The customer's delivery address must be in Switzerland or Liechtenstein.
If the customer does not accept the ordered products on the agreed or indicated delivery date, R\u00fcegg AG may terminate (cancel) the contract and invoice the customer for the delivery costs incurred and any loss in value.<\/p>\n\n\n\n

7. Inspection obligation<\/strong><\/h5>\n\n\n\n

The customer is obliged to check delivered or collected products immediately upon receipt for correctness, completeness and any delivery damage. Any discrepancies must be reported within 5 working days of receipt.
<\/p>\n\n\n\n

8. Warranty<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG guarantees that the ordered product is free of defects and functional for 24 months after delivery or collection.
When making a claim, the customer must register the product and the corresponding invoice as a warranty claim via the personal customer account in the R\u00fcegg webshop and return it in accordance with the instructions described there. R\u00fcegg AG will inform the customer in writing about the further course of the warranty claim.
If the warranty request is granted, R\u00fcegg AG can provide the warranty either by crediting the current price (maximum the sales price at the time of the order) or by providing a new product.

9. Liability and exclusion of liability<\/strong><\/h5>\n\n\n\n
9.1 Liability<\/strong><\/h5>\n\n\n\n

Liability shall be governed by the applicable statutory provisions. However, R\u00fcegg AG shall in no event be liable for slight negligence, indirect and consequential damages and loss of profit, unrealized savings, damages resulting from delay in delivery and any acts and omissions of auxiliary persons of R\u00fcegg AG, whether contractual or non-contractual.
Furthermore, R\u00fcegg AG accepts no liability in the following cases:
- improper, non-contractual or unlawful storage, adjustment or use of the products
- Use of incompatible spare parts or accessories
- failure to maintain and\/or improper modification or repair of the products by the customer or a third party
- force majeure, in particular damage caused by the elements, moisture, falling and impact, etc., for which R\u00fcegg AG is not responsible
- and official orders<\/p>\n\n\n\n

9.2 No guarantee for completeness and correctness<\/strong><\/h5>\n\n\n\n

The information published on the R\u00fcegg webshop is provided by R\u00fcegg AG exclusively for personal use and for information purposes. It is subject to change at any time and without prior notice. R\u00fcegg AG makes no warranty (express or implied) that the information published on the R\u00fcegg webshop is accurate, complete or up-to-date, even if due care has been taken in collecting it from sources believed to be reliable.<\/p>\n\n\n\n

9.3 Limitations of liability<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG disclaims without limitation all liability for any loss or damage of any kind, whether direct, indirect or consequential, which might be incurred through the use of or access to the R\u00fcegg webshop or through links to third-party websites. R\u00fcegg AG does not guarantee that the individual parts of the R\u00fcegg webshop will function without error. Furthermore, R\u00fcegg AG accepts no liability for manipulation of the Internet user's computer system by unauthorized persons.<\/p>\n\n\n\n

9.4 Use of the R\u00fcegg webshop<\/strong><\/h5>\n\n\n\n

The entire content (design, text, graphics, ...) of the R\u00fcegg webshop is protected by copyright. The individual elements of the website belong exclusively to the website operator R\u00fcegg AG. The saving or printing of individual pages and\/or sections of the R\u00fcegg webshop is only permitted with full acknowledgement of the source. By saving or otherwise reproducing software or other data on the R\u00fcegg webshop, the respective terms of use are deemed to have been accepted. All property rights remain with R\u00fcegg AG. The complete or partial reproduction, transmission (electronically or by other means), modification, linking or use of the R\u00fcegg Webshop is only permitted with the express written consent of R\u00fcegg AG. In particular, the use of tools that systematically and automatically retrieve, index and\/or transmit content from the R\u00fcegg web store (e.g. so-called spiders, crawlers and other automated tools) is also prohibited. R\u00fcegg AG expressly reserves the right to take action against the perpetrators, in particular to claim damages.<\/p>\n\n\n\n

9.5 Linked websites (links)<\/strong><\/h5>\n\n\n\n

Certain links on the R\u00fcegg webshop lead to third-party websites. These are completely beyond the control of R\u00fcegg AG, which is why R\u00fcegg AG accepts no responsibility whatsoever for the accuracy, completeness and legality of the content of such websites or for any offers contained therein.<\/p>\n\n\n\n

9.6 Obligations and liability of the customer<\/strong><\/h5>\n\n\n\n

By registering, the customer undertakes to provide all the information required to open a personal customer account in the R\u00fcegg webshop truthfully and completely.
There is no entitlement to open a personal customer account in the R\u00fcegg Webshop. R\u00fcegg AG may at any time and without giving reasons refuse to open a personal customer account in the R\u00fcegg Webshop or revoke a personal customer account once granted in the R\u00fcegg Webshop at any time and without prior notice and without giving reasons.
The customer is obliged to keep the login data for the customer account strictly confidential and shall take appropriate measures to protect their account from unauthorized access, in particular by using a secure password and up-to-date browser versions and anti-virus software.
All actions, in particular orders, which are processed via the customer's customer account shall be attributed to the customer. In particular, customers are liable for orders placed via their customer account.
<\/p>\n\n\n\n

10. Payment<\/strong><\/h5>\n\n\n\n
10.1 Payment options<\/strong><\/h5>\n\n\n\n

Customers can use the payment methods offered in the R\u00fcegg webshop under payment options.
Payments must be made in Swiss francs.
If you pay by credit card or other instant payment methods, you will be charged when you place your order.
In the case of purchase on account, the customer is obliged to pay the invoice amount within the payment period without any deductions. In the event of a partial return, the amount of the returned items will be credited less any return costs or discounts.<\/p>\n\n\n\n

10.2 Default of payment<\/strong><\/h5>\n\n\n\n

If the customer fails to meet its payment obligations in whole or in part, all outstanding amounts owed by the customer to R\u00fcegg AG under any title shall become due immediately and R\u00fcegg AG may demand immediate payment and suspend further deliveries of products to the customer.
R\u00fcegg AG charges a collection fee of CHF 10 for the first reminder, CHF 15 for the second reminder and CHF 20 for the third reminder.
Unpaid claims will be collected by legal action after unsuccessful reminders. In addition to settling the invoice amount, the customer shall also be obliged to reimburse all costs incurred in connection with the delay in payment (in particular default interest in accordance with the Swiss Code of Obligations, reminder fees, collection costs and lawyers' fees). The collection costs in the amount of this information shall be deemed to have been accepted by the customer irrespective of any proof of loss.<\/p>\n\n\n\n

10.3 Retention of title<\/strong><\/h5>\n\n\n\n

Ordered products remain the property of R\u00fcegg AG until full payment has been made to R\u00fcegg AG. R\u00fcegg AG is entitled to make a corresponding entry in the retention of title register.
<\/p>\n\n\n\n

11. Modification of the order or cancellation<\/strong><\/h5>\n\n\n\n

Orders oblige the customer to accept the products. R\u00fcegg AG may, at its own discretion, accept subsequent changes or cancellations of orders placed by the customer and charge a handling fee of 20% of the canceled order value, but at least CHF 50.
If a partial or delivery impossibility occurs after an order or the conclusion of a contract in accordance with section 3, the customer will be informed immediately by e-mail. If the customer has already paid, this amount will be refunded. If no payment has yet been made, the customer shall be released from the obligation to pay. Further claims for late delivery or non-delivery are excluded.
<\/p>\n\n\n\n

12. Return of faultless goods<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG grants the right to return the ordered products within a period of 10 working days from the date of delivery. Products that were specially procured at the customer's request are excluded from the right of return.
Customers must register the return of the products via their personal customer account in the R\u00fcegg webshop and return them in accordance with the instructions described there. The products must be in as-new condition and properly packed in their original packaging. Damaged products will not be taken back or will be charged to the customer in full.
If the customer exercises their right of return, R\u00fcegg AG will refund the entire purchase price less any minimum quantity surcharge paid and the return costs.
The customer assures R\u00fcegg AG that the details and list of returned products are complete and correct according to the return slip generated by the customer in the return process, and that the return shipment actually contains the products specified in the return slip.
<\/p>\n\n\n\n

13. Further provisions<\/strong><\/h5>\n\n\n\n
13.1 Non-assignable returns<\/strong><\/h5>\n\n\n\n

Returns that cannot be assigned to a customer or cannot be returned to the customer will be kept by R\u00fcegg AG for six months and then disposed of.<\/p>\n\n\n\n

13.2 Data protection<\/strong><\/h5>\n\n\n\n

Data protection is a matter of trust and your trust is important to us. In the R\u00fcegg webshop, personal and\/or company data is collected when a customer account is created or orders are placed. R\u00fcegg AG uses this data to communicate with customers and to process and deliver orders. In doing so, R\u00fcegg AG complies with the applicable provisions of Swiss data protection legislation.<\/p>\n\n\n\n

13.3 Divisional validity<\/strong><\/h5>\n\n\n\n

Should individual provisions of these GTC be invalid or ineffective, this shall not affect the validity of the remaining provisions and these GTC as a whole.<\/p>\n\n\n\n

13.4 Place of jurisdiction and applicable law<\/strong><\/h5>\n\n\n\n

All legal relationships between R\u00fcegg AG and the customer are subject to substantive Swiss law. The Vienna Sales Convention is not applicable.
The place of jurisdiction for actions brought by consumers is their place of residence or Zurich.
In all other cases, Zurich shall be the exclusive place of jurisdiction.<\/p>\n\n\n\n
