Terms and Conditions (T&C).<\/p>\n<\/div><\/div>\n\n\n\n

1. Scope<\/strong><\/h5>\n\n\n\n

Terms and Conditions (hereinafter Terms and Conditions <\/strong>(hereinafter referred to as) shall apply to all legal transactions entered into via the online ordering platform www.rueggag.ch (hereinafter R\u00fcegg-Webshop<\/strong> called), by telephone or email with Arthur R\u00fcegg Vehicle Accessories Ltd (hereinafter R\u00fcegg Ltd<\/strong> concluded. Deviating and contradicting terms require a special written agreement and take precedence over these T&Cs.
R\u00fcegg AG reserves the right to change these Terms and Conditions at any time. The version of these Terms and Conditions applicable at the time of the order is decisive and cannot be unilaterally altered for this order.
The range of products offered by R\u00fcegg AG is exclusively aimed at customers residing or having their registered office in Switzerland or Liechtenstein. Deliveries will only be made to addresses within Switzerland or Liechtenstein.

2. Information<\/strong><\/h5>\n\n\n\n
2.1 Product and Price<\/strong><\/h5>\n\n\n\n

Illustrations of products in advertisements, brochures, the R\u00fcegg webshop, etc. are for illustrative purposes only and are non-binding.
All prices published in the R\u00fcegg webshop are given in CHF, either including or excluding VAT. The published gross prices (RRP) are non-binding price recommendations and are not binding for retailers. R\u00fcegg AG reserves the right to change the prices of the products offered at any time. The price in the R\u00fcegg webshop at the time of the order is decisive for the conclusion of the purchase contract. Pricing for the invoicing of backorders shall be carried out according to the terms and conditions valid on the day of dispatch or collection.<\/p>\n\n\n\n

2.2 Availability and Delivery Time<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG places great importance on providing up-to-date and accurate availability and delivery times in the R\u00fcegg webshop. However, delivery delays may occur, particularly due to production or supply bottlenecks. All information regarding availability and delivery times is therefore without guarantee and may change at any time.
<\/p>\n\n\n\n

3. Contract conclusion<\/strong><\/h5>\n\n\n\n

The products and prices in the R\u00fcegg webshop are considered an offer. However, this offer is always subject to the condition of delivery impossibility, which shall terminate the contract.
The purchase agreement for products from R\u00fcegg AG is concluded with R\u00fcegg AG once the customer places their order in the R\u00fcegg webshop, by telephone, or by email (hereinafter referred to as the purchase agreement).
The arrival of a R\u00fcegg webshop order is communicated to the customer via an automatically generated order confirmation from R\u00fcegg AG to the email address they provided. Receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the customer that the order placed has arrived at the R\u00fcegg webshop and that the purchase contract with R\u00fcegg AG has therefore been concluded, subject to the condition of availability.
<\/p>\n\n\n\n

4. Delivery deadline<\/strong><\/h5>\n\n\n\n

With the order confirmation, a provisional delivery date is communicated to the customer, or the customer is contacted and an individual delivery date is agreed upon.
If R\u00fcegg AG is in default of delivery, the customer (except for special orders) has the right to withdraw from the contract from the 10th working day after the originally announced delivery date. In this case, R\u00fcegg AG will refund any amounts already paid in advance to the customer. There are no further claims against R\u00fcegg AG.
<\/p>\n\n\n\n

5. Delivery<\/strong><\/h5>\n\n\n\n

All products from R\u00fcegg AG are delivered from the R\u00fcegg logistics centre in Switzerland.
All delivery and collection options shown in the R\u00fcegg webshop during the ordering process are available to customers.
The customer's delivery address must be in Switzerland or Liechtenstein.
If the customer does not accept the ordered products on the agreed or displayed delivery date, R\u00fcegg AG may dissolve (cancel) the contract and charge the customer for the resulting delivery costs and any depreciation in value.<\/p>\n\n\n\n

7. Duty to inspect<\/strong><\/h5>\n\n\n\n

Customers are obliged to check delivered or collected products for accuracy, completeness, and any delivery damage immediately upon receipt. Any discrepancies must be reported within 5 working days of receipt.
<\/p>\n\n\n\n

8. Guarantee<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG provides a warranty for the freedom from defects and operational capability of the ordered product for 24 months following delivery or collection.
Customers must register the product and the corresponding invoice as a warranty claim via their personal customer account in the R\u00fcegg webshop when making a claim, and return it in accordance with the instructions described there. R\u00fcegg AG will inform the customer in writing about the further progress of the warranty claim.
If the warranty claim is approved, R\u00fcegg AG may fulfil the warranty either by crediting the current daily price (up to the sales price at the time of order) or by providing a new product.
<\/p>\n\n\n\n

9. Liability and Disclaimer<\/strong><\/h5>\n\n\n\n
9.1 Liability<\/strong><\/h5>\n\n\n\n

The liability is governed by the applicable statutory provisions. However, R\u00fcegg AG shall in no event be liable for slight negligence, indirect and consequential damages, loss of profit, unrealised savings, damages resulting from delays in delivery, and any acts or omissions by R\u00fcegg AG's vicarious agents, whether contractual or non-contractual.
Furthermore, R\u00fcegg AG disclaims liability in the following cases:
Improper, non-contractual or unlawful storage, installation or use of the products
\u2022 Use of incompatible replacement or accessory parts
\u2022 Failure to maintain and\/or improper alteration or repair of the products by the customer or a third party
\u2022 Force majeure, in particular elemental, moisture, fall, and impact damage, etc., for which R\u00fcegg AG is not liable
and regulatory orders<\/p>\n\n\n\n

9.2 No guarantee of completeness and accuracy<\/strong><\/h5>\n\n\n\n

The information published on the R\u00fcegg webshop is provided by R\u00fcegg AG solely for personal use and informational purposes, and may be changed at any time without prior notice. R\u00fcegg AG provides no warranty (whether express or implied) for the accuracy, completeness and timeliness of the information published on the R\u00fcegg webshop, even if the utmost care has been taken in compiling it from sources believed to be reliable.<\/p>\n\n\n\n

9.3 Limitations of Liability<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG expressly excludes all liability for losses or damages of any kind, whether direct, indirect or consequential, that may arise from the use of or access to the R\u00fcegg webshop or from links to third-party websites. R\u00fcegg AG does not guarantee that individual parts of the R\u00fcegg webshop will function without error. Furthermore, R\u00fcegg AG accepts no liability for any manipulation of the internet user's IT system by unauthorised persons.<\/p>\n\n\n\n

9.4 Using the R\u00fcegg Webshop<\/strong><\/h5>\n\n\n\n

All content (design, text, graphics, etc.) of the R\u00fcegg webshop is protected by copyright. The individual elements of the website exclusively belong to the website operator R\u00fcegg AG. Saving or printing individual pages and\/or parts of the R\u00fcegg webshop is only permitted with full source attribution. By saving or otherwise duplicating software or other data on the R\u00fcegg webshop, the respective terms of use are deemed accepted. All ownership rights remain with R\u00fcegg AG. Complete or partial reproduction, transmission (electronically or by other means), modification, linking, or use of the R\u00fcegg webshop is only permitted with the express written consent of R\u00fcegg AG. Furthermore, the use of tools that systematically and automatically retrieve, index, and\/or transmit content from the R\u00fcegg webshop (e.g., so-called spiders, crawlers, and other automated tools) is expressly prohibited. R\u00fcegg AG expressly reserves the right to take action against those responsible, in particular to claim damages.<\/p>\n\n\n\n

9.5 Linked Websites<\/strong><\/h5>\n\n\n\n

Certain links on the R\u00fcegg webshop lead to third-party websites. These are entirely outside of R\u00fcegg AG's control, and therefore R\u00fcegg AG accepts no responsibility for the accuracy, completeness, or legality of the content of such websites, nor for any offers contained on them.<\/p>\n\n\n\n

9.6 Customer Obligations and Liability<\/strong><\/h5>\n\n\n\n

By registering, customers undertake to provide all the necessary details for opening a personal customer account in the R\u00fcegg webshop truthfully and completely.
There is no entitlement to the opening of a personal customer account in the R\u00fcegg webshop. R\u00fcegg AG may refuse the opening of a personal customer account in the R\u00fcegg webshop at any time and without stating reasons, or revoke an already granted opening of a personal customer account in the R\u00fcegg webshop at any time and without prior notice and without stating reasons.
Customers are obliged to keep the login details for their customer account strictly confidential and to take appropriate measures to protect their account from unauthorised access, such as using a secure password, using current browser versions and antivirus software.
All actions, in particular orders, which are processed via the customer's account, shall be attributed to the customer. In particular, the customer shall be liable for orders placed via their customer account.
<\/p>\n\n\n\n

10. Payment<\/strong><\/h5>\n\n\n\n
10.1 Payment Options<\/strong><\/h5>\n\n\n\n

The customer can use the payment methods offered in the R\u00fcegg webshop under Payment Options.
Payments must be made in Swiss francs.
When paying by credit card or other instant payment methods, the charge will be made upon ordering.
When purchasing on account, customers are obliged to pay the invoice amount within the payment period without any deductions. In the event of a partial return, the amount of the returned items will be credited, less any return costs or discounts.<\/p>\n\n\n\n

10.2 Payment Default<\/strong><\/h5>\n\n\n\n

If the customer fails to meet their payment obligations in full or in part, all outstanding amounts owed by the customer to R\u00fcegg AG for any reason shall become immediately due and payable, and R\u00fcegg AG may demand them immediately and cease further deliveries of products to the customer.
R\u00fcegg AG charges CHF 10 for the first reminder, CHF 15 for the second reminder, and CHF 20 for the third reminder.
Unpaid claims will be recovered through legal action after a formal reminder has been unsuccessful. In addition to settling the invoice amount, the customer is obliged to reimburse all costs incurred in connection with the payment delay (in particular, default interest in accordance with the Swiss Code of Obligations, reminder fees, collection costs, and legal fees). The collection costs in the specified amount are considered accepted by the customer, regardless of proof of damage.<\/p>\n\n\n\n

10.3 Retention of title<\/strong><\/h5>\n\n\n\n

Ordered products remain the property of R\u00fcegg AG until full payment has been received. R\u00fcegg AG is entitled to make an appropriate entry in the retention of title register.
<\/p>\n\n\n\n

11. Amendment or cancellation of order<\/strong><\/h5>\n\n\n\n

Placing an order obliges the customer to accept the products. R\u00fcegg AG may, at its discretion, accept subsequent changes to or cancellations of customers\u2019 orders and may charge an administration fee of 20% of the value of the cancelled order, subject to a minimum charge of CHF 50.\u2013.
If partial or total impossibility of delivery occurs after an order or the conclusion of the contract in accordance with clause 3, the customer will be informed immediately by e-mail. If the customer has already paid, this amount will be refunded. If payment has not yet been made, the customer will be released from the obligation to pay. Further claims due to delivery delays or failure of delivery are excluded.
<\/p>\n\n\n\n

12. Return of goods without defects<\/strong><\/h5>\n\n\n\n

R\u00fcegg AG grants the right to return ordered products within a period of 10 working days from the date of delivery. Products that were specially procured at the customer's request are excluded from the right of return.
Customers must register product returns via their personal customer account in the R\u00fcegg webshop and return them according to the instructions outlined therein. Products must be packaged properly in new condition and in their original packaging. Damaged products will not be accepted or will be invoiced to the customer in full.
If the customer exercises their right of return, R\u00fcegg AG will refund the full purchase price less any surcharges for small quantities paid and return costs.
The customer assures R\u00fcegg AG that the details and list of returned products are complete and accurate according to the returns slip generated by the customer during the returns process, and that the returns shipment actually contains the products listed on the returns slip.
<\/p>\n\n\n\n

13. Further provisions<\/strong><\/h5>\n\n\n\n
13.1 Unallocated Returns<\/strong><\/h5>\n\n\n\n

Returns that cannot be assigned to a customer or returned to the customer will be stored by R\u00fcegg AG for six months and then disposed of.<\/p>\n\n\n\n

13.2 Data Protection<\/strong><\/h5>\n\n\n\n

Data protection is a matter of trust, and your trust is important to us. When you create a customer account or place orders in the R\u00fcegg webshop, personal and\/or company data is collected. R\u00fcegg AG uses this data in its communication with customers and for processing and delivering orders. R\u00fcegg AG adheres to the applicable provisions of Swiss data protection legislation.<\/p>\n\n\n\n

13.3 Partial Invalidity<\/strong><\/h5>\n\n\n\n

If individual provisions of these terms and conditions are invalid or unenforceable, this shall not affect the validity of the remaining provisions and of these terms and conditions as a whole.<\/p>\n\n\n\n

13.4 Jurisdiction and applicable law<\/strong><\/h5>\n\n\n\n

All legal relationships between R\u00fcegg AG and customers are subject to Swiss substantive law. The Vienna Sales Convention is not applicable.
For consumer complaints, their place of residence or Zurich is the place of jurisdiction.
In all other cases, Zurich shall be the exclusive place of jurisdiction.<\/p>\n\n\n\n
